1. Suspension and Termination
Your rights under this Agreement will terminate immediately and automatically without notice from Big Alpha Games if you fail to comply with any of its terms. Big Alpha Games, at its sole discretion, may modify, discontinue, or suspend your access to any of our services or apps at any time.
Big Alpha Games may also suspend or terminate any license granted herein and disable the apps or their features at any time, with or without reason. You agree that Big Alpha Games shall not be liable to you or any third party for any suspension, termination, or disabling of the apps.
Upon termination or expiration of this Agreement, you must immediately cease all use of the Big Alpha Games apps and destroy all copies in your possession or control. Termination will not limit any of Big Alpha Games’ rights or remedies at law or in equity.
2. Privacy and Data Protection
In compliance with applicable data protection laws, all personal data you provide through the use of our services shall be processed in accordance with our Privacy Policy. By accepting this Agreement, you also acknowledge and accept our Privacy Policy and the terms within.
When using Big Alpha Games apps, we may request permission to access certain data such as your location or send push notifications. You may control these permissions through your device settings. Disabling permissions may restrict access to specific features or impact functionality.
3. Intellectual Property
The Big Alpha Games name, logo, trademarks, and all related design elements—including text, images, artwork, code, and software—are the exclusive property of Big Alpha Games and its licensors. You may not copy, imitate, or use them in any form without prior written consent.
The app and its contents are protected by copyright, trademark, and other proprietary laws. All rights are reserved to Big Alpha Games and its partners.
4. Disclaimer
The apps and services are provided on an “as is” and “as available” basis without warranties of any kind. To the fullest extent permitted by law, Big Alpha Games disclaims all warranties—express or implied—regarding accuracy, reliability, availability, non-infringement, or fitness for a particular purpose.
Big Alpha Games does not guarantee uninterrupted or error-free operation of the apps, nor the accuracy of results obtained from using them. We assume no responsibility for any damage caused by unauthorized access, service interruptions, data loss, viruses, or any other issues arising from app usage.
5. Limitation of Liability
Big Alpha Games shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the apps or services. This includes loss of business, data, profits, or goodwill, even if we have been advised of the possibility of such damages.
Our total liability, whether in contract, tort, or otherwise, shall not exceed the amount you paid (if any) for accessing or using the apps.
6. Indemnity
You agree to indemnify, defend, and hold harmless Big Alpha Games, its affiliates, officers, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of our apps, violation of these terms, or infringement of any third-party rights.
7. Applicable Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of Spain, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Spain for any disputes arising under or related to this Agreement.
If any provision of this Agreement is found to be unlawful or unenforceable, the remaining provisions shall remain valid and enforceable. Any cause of action related to the Big Alpha Games apps must be filed within three (3) years of the cause arising.
